A 15-year-old boy was sexually assaulted while asleep in a tent at a house party – and justice has now been firmly upheld after the accused failed to overturn her conviction on appeal.
Cynthia Frahn Guilty of Assaulting Teen in Tent
Cynthia Frahn, 53, was found guilty in June 2023 of sexually assaulting the boy at her home in Monarto, near Adelaide, Australia. The teenager had lost consciousness at the party and was asleep when he woke to find Frahn performing a sex act on him. A jury convicted Frahn, who was sentenced to four years behind bars, with a minimum of two-and-a-half years before parole.
Frahn’s Appeal Fails: DNA Evidence Challenges Rejected
Frahn tried to get her conviction and sentence overturned, claiming a miscarriage of justice linked to DNA evidence used in her trial. Her defence argued the judge fell victim to “the prosecutor’s fallacy” and suggested the DNA results could be due to innocent transfer.
Appeal judges reviewed parts of the case but dismissed the entire challenge.
Judges Confirm Verdict Was Solid
“The DNA was not the only evidence,” the panel ruled. The decision confirmed the teen “was not willing and did not acquiesce” in Frahn’s actions.
Frahn remains behind bars following the failed appeal, as the court stands behind the original guilty verdict.
