Legal Win: Judge Rules Abu’s Isolation Breached Human Rights

Abu took legal action against the Ministry of Justice (MoJ) claiming that extended segregation caused severe depression and PTSD. On November 18, Mr Justice Sheldon slammed the government’s stance.

“His segregation cannot be justified substantively,” the judge ruled. “It interfered with Abu’s human rights.”

The judge said he will consider whether damages need to be paid to Abu for the ordeal.

Government Outraged, Threatens Appeal

The MoJ is weighing up an appeal. Justice minister Alex Davies-Jones confirmed the government is exploring all options, including challenging the ruling in court.

Shadow justice secretary Robert Jenrick blasted the decision, saying:

“This ruling has created a perverse situation where a terrorist’s mental health is prioritised over national security.”
