Two Cops Deny Assaulting 93-Year-Old Dementia Patient With Taser and Baton
Shockwaves have hit St Leonards-on-Sea after two police officers denied assaulting a 93-year-old dementia sufferer in a care home – despite reportedly using a Taser, incapacitant spray, handcuffs, and a baton on the elderly man.
The Incident: Taser and Baton Used on Elderly Patient
Pc Stephen Smith, 50, and Pc Rachel Comotto, 34, appeared at Westminster Magistrates’ Court charged with assault occasioning actual bodily harm. The incident unfolded on June 21, 2022, at Park Beck care home after Donald Burgess allegedly threatened staff with a knife.
The court heard officers used a Taser, incapacitant spray (Pava), handcuffs, and a baton to subdue Mr Burgess, who was later hospitalised. Tragically, he passed away three weeks later.

Both officers have been granted unconditional bail. They face further proceedings at Southwark Crown Court on May 23.
Investigation and Family’s Heartfelt Tribute
The Independent Office for Police Conduct (IOPC) confirmed evidence does not directly link the incident to Mr Burgess’s death. Sussex Police referred the case voluntarily for independent investigation.

Mr Burgess’s family remembered him as a devoted husband and kind soul. His cousin, Shirley Fitch, shared how his health declined after his wife Ethel’s passing, leading to his move into care. Despite his struggles, he remained a beloved, sociable figure in the community.
