Enoch Burke Faces Christmas Behind Bars After High Court Denies Release

Enoch Burke, the former Wilson’s Hospital School teacher from County Westmeath, is set for a grim festive season locked up. The High Court has slammed the door on his bid for release. Mr Justice Brian Cregan ruled Burke’s refusal to promise he won’t trespass means he’ll spend Christmas behind bars.

Burke has been held in Mountjoy Prison since his arrest near the school in late November for breaching a 2022 court injunction. His next chance for release won’t come until March 3, 2026, locking him up for New Year’s too.

Justice Cregan shot down Burke’s claim of religious persecution. The judge made it clear this is all about property rights and obeying court rulings – not Burke’s Christian beliefs.

The judge slammed Burke’s actions as a “fanatical campaign” and a “deliberate, sustained and concerted attack” on the rule of law. The court even warned Burke’s family it would clamp down on any disruptions during hearings, threatening to restrict their attendance.

A new hearing is set for December 13 in Athlone to review Burke’s dismissal, with an appeals panel probing how the school handled firing him.

Meanwhile, courts have ordered his salary — which bizarrely continues to be paid despite his sacking — to be redirected to cover £11,500 (€15,000) in damages owed to the school. There’s also talk of seizing Burke family vehicles linked to earlier trespassing as part of efforts to crack down on the ongoing contempt.

Burke’s courtroom support includes siblings Isaac and Ammi, who are themselves locked in legal battles over discrimination claims. The family saga is creating a tangled web of high-profile court fights drawing intense attention.
