Canterbury Business Sentenced for Breaching Fire Safety Regulations – UKNIP

A Kent-based business, Canterbury Masala Ltd, has been sentenced by Folkestone Magistrates Court for failing to ensure adequate fire safety measures were in place at its premises, Masala Gate in North Gate, Canterbury. The company has been issued fines, a victim surcharge, and ordered to pay costs following safety concerns identified by building safety inspectors from the Kent Fire and Rescue Service (KFRS).

During a visit in June 2021, KFRS inspectors discovered multiple safety issues at the takeaway shop, prompting legal action. On 5th July, Canterbury Masala Ltd appeared in court and pleaded guilty to four breaches of the Regulatory Reform (Fire Safety) Order 2005, which placed individuals at risk of serious injury or death in the event of a fire.

The offences included the absence of a fire detection and warning system, inadequate fire risk assessment, and insufficient emergency exit routes. These violations compromised the safety of both staff and customers within the premises.

Canterbury Masala Ltd has been fined £4,000, ordered to pay a victim surcharge of £190, and instructed to cover costs amounting to £19,293. The severity of the penalties reflects the seriousness of the safety breaches and emphasizes the legal obligation businesses have to ensure the safety of their employees and visitors.

Suzanna Chisholm, Head of Building Safety at KFRS, highlighted the importance of fire safety compliance for all businesses. Chisholm stated, “We will always offer support and advice to any business that needs our help, but if you fail to comply with fire safety regulations and put people’s lives at risk, then we will prosecute when necessary.”

Chisholm added, “We hope the sentence issued to Canterbury Masala Ltd will remind other businesses across Kent and Medway to ensure they are consistently fire compliant to avoid prosecution and, most importantly, to keep everyone safe.
