West Wickham Man Escapes Jail After Sex Chat with 13-Year-Old
Nicholas Pharo, 27, from Deer Park Way in West Wickham, has dodged prison despite admitting to sending sexual messages to a 13-year-old girl. The disturbing case unfolded at Croydon Crown Court on April 10, 2024.
Breaking His Sexual Harm Prevention Order
Pharo was already under a Sexual Harm Prevention Order (SHPO) after a 2019 child pornography conviction. The SHPO banned him from contacting children online. Yet, within a year, he flagrantly broke the rules by engaging in explicit communications with the minor.
Prosecutor Bill McGivern revealed Pharo had discussed sexual fantasies with the youngster and even suggested buying her a sex toy. Despite denying the allegations initially, Pharo later admitted the offences.
Defence Cites Autism and Maturity Issues
Pharo’s lawyer, Janice Brennan, argued his autism played a big role in his offending. She described his difficulties with relationships, empathy, and understanding social boundaries. Brennan claimed that while the age gap was big, the maturity difference was less clear.
Judge Suspends Jail Sentence, Warns of Tough Consequences
Judge Michael Evans KC handed Pharo a 20-month custodial sentence — suspended for two years. The judge acknowledged Pharo’s mental health struggles and saw potential for rehabilitation. Crucially, Evans warned Pharo that any repeat offences would lead to immediate jail time.
Judge Evans: “This is a serious breach and will not be taken lightly. Future misconduct will result in custody without hesitation.”
This case spotlights the tricky balance courts face when dealing with offenders who have mental health conditions, questioning if support systems are tough and effective enough.
