New Police Powers to Tackle Anti-Social Behaviour
Under Section 35 of the Anti-Social Behaviour, Crime, and Policing Act 2014, uniformed Police Constables (PCs) and Police Community Support Officers (PCSOs) can now kick individuals out of an area for up to 48 hours. But this action requires the green light from an Inspector.
When Can Police Use This Dispersal Power?
The officer must have solid reasons to believe the person’s behaviour is:
- Harassing, alarming, or distressing the public
- Causing or likely to spark crime or disorder
- Serious enough to warrant removal to stop trouble escalating
Wide-Ranging, Proactive Authority
This power doesn’t just kick in after trouble erupts. Police can use it when anti-social behaviour or crime is likely to happen. It applies anywhere—no need for setting up official dispersal zones.
Special Rules for Kids
For under-16s, officers can remove them to their home or a safe spot instead of just pushing them out on the street.
