Hospital receptionist wins £19,000 after brutal attack by security guard

Violent Tussle at Lewisham Hospital

A hospital receptionist has secured over £19,000 compensation following a brutal attack by a security guard during a fiery altercation at Lewisham and Greenwich NHS Trust.

The drama unfolded in July 2021 when Ben Murphy, an administrator, clashed with a security guard from CIS Security. What started as cheeky banter quickly turned nasty after the guard called Murphy “fat”. Things escalated when Murphy reportedly told the guard, “don’t get your mother’s knickers in a twist.”

The guard then allegedly grabbed Murphy by the throat and smashed his head against a wall, leaving Murphy fearing for his life. Murphy fought back by putting the guard in a headlock and landing punches before other security staff stepped in.

Suspended, Warned, then Forced Out

  • The security guard was sacked by CIS Security.
  • Despite being attacked, Murphy was suspended by the NHS Trust and slapped with a written warning for misconduct.
  • Feeling let down and fearing for his safety, Murphy resigned.

Employment Tribunal Backs Murphy

At the tribunal, Murphy claimed unfair and wrongful dismissal, unlawful wage deductions and health and safety detriment. Though his dismissal claims were rejected, the tribunal sided with Murphy over health and safety.

  • The trust failed to recognise Murphy acted in self-defense.
  • They provided poor support during his suspension.
  • Judge Amanda Hart ruled Murphy’s suspension was unfair, influenced by his reaction while in danger.

£19,300 Payout Sends Strong Message

In October 2024, Murphy was awarded £4,300 for lost wages during suspension plus £15,000 for injury to feelings—totaling more than £19,000.

A Lewisham and Greenwich NHS Trust spokesperson said:

“We accept the outcome of the tribunal and have nothing further to add.”

Workplace Safety Under the Spotlight

The ruling has ignited debate about how NHS trusts handle violent incidents and protect staff acting in self-defense. Experts say employers must provide proper support and fair treatment during investigations to ensure employee safety and wellbeing.
