Family Courts Crisis Leaves Tens of Thousands of UK Kids in Limbo
Tens of thousands of children in the UK are stuck in a family courts nightmare, warns the Law Society of England and Wales. The crisis is wreaking havoc on young lives, with urgent government action needed now.
Record Delays Leave Kids Waiting Nearly a Year
The Ministry of Justice reveals shocking figures: from January to March 2024, 27,445 children were involved in new family court cases. But the wait for decisions on where children will live and who they’ll see is dragging on—averaging 11 months.
Last year, over 100,000 children were trapped in court backlogs. The crisis is spiralling, with the Law Society warning a further 25,000 children could get caught up unless the next UK government steps in.
Law Society Demands Action – Here’s the Fix
- Restore Legal Aid: Early legal advice would help families settle disputes before they reach court, saving time and stress.
- Early Advice Pilot: Expanding this scheme could stop cases spiralling and ease pressure on already overwhelmed family courts.
Children ‘Victims of a Broken System’
Law Society president Nick Emmerson said: “Children are forced to wait almost a year in limbo because of record backlogs. The stress and anxiety can have lasting damage on their mental health.” “Kids are victims of this dire family courts crisis. The system should protect them, but instead, delays and inefficiencies are letting them down.”
The clock is ticking. Without swift reform, thousands more young lives will be caught in legal limbo, suffering the fallout of a justice system on the brink.
