A man suffering from delirium has been locked up for 12 years after punching an 88-year-old retired farmer to death at Mercy University Hospital (MUH) in Cork.

Dylan Magee Found Guilty of Manslaughter

Dylan Magee, 33, was cleared of murder but found guilty of manslaughter by reason of diminished responsibility for the death of Matthew Healy. The kind, humble 88-year-old from Berrings, Co Cork, was struck over 20 times in the hospital ward on January 22, 2023. Magee was admitted to MUH on January 19 after an urgent GP referral. He was hallucinating, hearing voices and seeing dead people. Doctors found he had taken 120 benzodiazepine pills in the week before admission and tested positive for morphine and cannabis-related chemicals.

Attack Details Reveal Disturbing Scene

At around 5.15am on January 22, Magee became agitated and attacked Healy, who was asleep in a neighbouring bed. Magee punched the elderly man 4-6 times before the staff intervened. Despite attempts to restrain Magee, he landed three more blows, injuring a nurse who broke a finger trying to stop him. Magee shouted, “This man ate my son,” though no such person existed. During police interviews, Magee admitted he had “lost the plot” and acknowledged beating a fellow patient. Both defence and prosecution psychiatrists agreed Magee’s mental state was severely impaired due to withdrawal delirium and addiction issues, making him unable to control his actions.

Judge Highlights Victim’s Vulnerability, Imposes 12-Year Sentence

At sentencing, Ms Justice Siobhan Lankford described Healy as “very helpless” and vulnerable. She acknowledged Magee’s 25 previous convictions and noted his remorse and guilty plea. The judge said Magee’s mental disorder was so severe he might have qualified for a verdict of not guilty by reason of insanity. The court initially considered a 20-year sentence but sentenced Magee to 13 years, suspending the final year to support his rehab and reintegration. Magee must attend probation and addiction aftercare services after release. His sentence was backdated to January 24, 2023.

“Guilty of manslaughter by reason of diminished responsibility is only suitable for genuinely ill individuals,” said Ms Healy, daughter of the victim. “Not for those suffering delirium due to self-induced drug withdrawal. We are the product of our choices, and I will never accept excuses suggesting the perpetrator was not responsible for his actions. His own life choices led to him punching our dad to death.” She called for the “absolute maximum sentence permitted by law” and said no family member should ever fear crossing paths with Magee again.
