Havant Man Who Sexually Assaulted Sleeping Teen Avoids Jail
A 42-year-old electrician from Havant, Daniel Martin Cake, has been handed a suspended sentence after sexually assaulting a 16-year-old girl following a house party. The victim, who cannot be named for legal reasons, was asleep next to her boyfriend when Cake, reportedly intoxicated, entered the bedroom and attacked her.
Intoxicated Offender Caught After Disturbance
Portsmouth Crown Court heard how Cake, drunk and high after a dozen beers, cannabis, and possibly cocaine, went into the bedroom where the girl was sleeping. The terrified teen kicked him off the bed, waking her boyfriend and causing a disturbance.
The commotion quickly drew the household’s attention. A man punched Cake in the face before he was thrown out. Police were called, and Cake—who is a father and reportedly in a “healthy relationship”—was arrested. He claimed to have no memory of the incident.
Judge Calls Assault “Appalling and Shocking” But Suspends Jail Term
Defence lawyer Jason Halsey described the incident as “shocking, humiliating and embarrassing,” but stressed Cake had no previous convictions and was of good character. The electrician admitted to one count of sexual assault on a female aged 16 or over.
Despite the serious nature of the crime, Judge Timothy Mousley QC sentenced Cake to 16 months in jail, suspended for two years. Cake must also complete 35 rehabilitation days, observe a 10-year restraining order and Sexual Harm Prevention Order, and register on the Sex Offenders’ Register for a decade.
Victim’s Family Furious as Offender Walks Free
After the sentencing, the victim’s mother spoke out in heartbreak: “My beautiful daughter innocently asleep in bed and he still walks our streets… This has truly broken my heart.”
She added a stinging rebuke to Cake and his supporters in court: “Mr Dan Cake, shame on you, and shame on your family and girlfriend who sat in that courtroom to support you.”
