England and Wales Jails Near Breaking Point: Public Safety at Risk

Prisons in England and Wales are dangerously close to running out of space, sparking warnings from the Prison Governors’ Association (PGA), which represents 95% of prison governors. Officials say the overcrowding crisis could pose a serious threat to public safety.

Police Could Soon Run Out of Prison Cells

In a stark letter to political leaders, the PGA warns police may soon have nowhere to detain offenders due to the lack of available cells. “The entire criminal justice system stands on the precipice of failure,” the letter states.

The latest Ministry of Justice figures reveal there are currently 87,395 inmates crammed into just 88,778 spaces. The PGA demands swift action, saying: “Procrastination is not an option – this is happening now.”

Ministry Considers Emergency Powers as Crisis Deepens

Sources within the Ministry of Justice say ministers are mulling over the Civil Contingencies Act 2004. This law would allow measures like early prisoner release during emergencies. However, insiders suggest any action will likely be delayed until after the election — if it happens at all.

A senior official described the scene inside prisons as “dire” and “deeply troubling.”

Calls for Immediate Reform and New Prison Builds

Last month, the government launched Operation Early Dawn to ease overcrowding by keeping some detainees longer in police custody or releasing others on bail. Yet the PGA calls for a far bolder move: routinely releasing prisoners after serving just 40% of their sentences — applied retrospectively.

Both major parties have pledged to tackle the crisis by building more prisons. The Conservatives aim to add 20,000 new spaces by 2030 by scrapping EU legacy rules, while Labour plans to create 20,000 places and allow ministers to override local planning authorities.

A government spokesperson said: “The police and prison service have long-established processes to manage short-term capacity issues. The Civil Service is working closely with justice partners to ensure we have the prison places needed to keep people safe.”
