A recycling company has been hit with a £40,000 fine after failing to maintain lifting equipment, a catastrophic oversight that led to the death of 65-year-old worker Henry Chambers. The fatal incident happened on July 5, 2019, at a refuse unloading bay on an aggregates site in Charlton, London.
While unloading glass bottles from a refuse vehicle, Chambers became trapped between the vehicle’s tailgate and hopper, suffering multiple crush injuries. Despite emergency efforts, he died four days later in hospital.

Henry’s widow, Gail Chambers, spoke emotionally about her husband’s lost dreams. “The Christmas before Henry died, we had just celebrated our 40th wedding anniversary. It was a 40-year marriage which shouldn’t have ended as abruptly as it did,” she said. “Henry was 65 and kept saying he wanted to retire, but there was no set time. We had plans. His big dream was to hire a Winnebago and drive Route 66, but he would have been just as happy down in Cornwall. His big things were holidays and family.”
Investigation Uncovers Shocking Maintenance Failures
The Health and Safety Executive (HSE) launched an investigation that exposed dangerous defects in the refuse vehicle’s lifting equipment. Key parts were worn and missing, revealing a shocking lack of upkeep. The equipment hadn’t been inspected by a competent person since the vehicle was bought in April 2017 – a violation of safety law.
HSE rules demand a thorough examination of lifting gear every 12 months by qualified personnel. But Bin Busy Recycling Limited only maintained the truck to keep it roadworthy, ignoring critical inspections of the lifting equipment.
Company Fined and Ordered to Pay Costs
Bin Busy, based in Erith, Kent, pleaded guilty to breaching the Lifting Operations and Lifting Equipment Regulations 1998 and the Provision and Use of Work Equipment Regulations 1998. Along with the £40,000 fine, the firm was ordered to pay over £22,000 in legal costs plus a victim surcharge.
HSE inspector Gordon Carson warned: “Bin Busy failed to effectively maintain the lifting equipment on this refuse vehicle or arrange for it to be thoroughly examined in accordance with specified timescales. Regular proactive maintenance is essential to prevent dangerous failures that cost lives.”
This grim case is a stark reminder that cutting corners on safety can have deadly consequences.
